论诬告行为的规制缺陷与路径创新

诬告行为是破坏党风、政风和社会风气的违法乱纪行为,其恶劣性在普通公民对国家公职人员进行诬告的领域尤为凸显。相关法律、党内法规虽已有针对诬告行为的相关规定,但是往往呈现出惩处措施抽象笼统、欠缺梯度与力度、封闭式处理导致的信息闭塞等规制缺陷。社会信用体系是当下我国自然人信用建设的新发展趋势,具有灵活性、渗透性等特征,因此可以提出一种将诬告行为纳入社会信用体系的新型路径,在对行为人信用进行梯度分级的基础上构建诬告案件网络终端,采用外部资源设限以及信息平台公开等措施对诬告行为进行规制,以弥合现有缺陷。

False accusations is a violation of the Party conduct,political atmosphere and social morality of the law and discipline,its badness is particularly highlighted in the field of ordinary citizens accuse the national public officials wrongly. Although there are regulations and the relevant provisions of the law against the false accusations,it is still shows a phenomenon of unclear punitive measure,lack of gradient and intensity,closed processing caused by information blocking and other regulatory defects. The social credit system is a new development trend of the credit construction of natural persons in our country,it has the characteristics of flexibility and permeability. Therefore,we can put forward a new path to incorporate false accusations into the social credit system. On the basis of gradient grading of the perpetrators＇ credit,the construction of false accusations of the case of network terminals,the use of external resource constraints and information platform open and other measures to regulate the false accusations and brblge the existing shortcomings.
