刑事法律援助中的辩护质量探析

On the Quality of Defense in Criminal Legal Aid

随着人权保障意识的加强,刑事法律援助辩护质量逐渐受到关注。但由于存在方方面面的原因,导致刑事法律援助的辩护质量存在着诸多问题,包括辩护率较低、辩护质量较差、刑事法律援助辩护律师难以提出有效的辩护意见,以及法官很难采纳刑事法律援助辩护律师的辩护意见等。而造成这些问题的原因主要包括,刑事法律援助律师难于行使相关的辩护权利、刑事法律援助律师介入的时间比较晚、刑事法律援助律师难以遵守忠诚义务、刑事法律援助案件的辩护质量得不到国家机关的重视。因此,需要从以下几个方面加强对刑事法律援助辩护质量的保障:法官拒绝采纳刑事法律援助律师提出的辩护意见时应当说明理由,优化刑事法律援助律师的执业环境、对刑事法律援助辩护的有效性给予重视,并构建刑事法律援助辩护质量监督机制。

With the strengthening of awareness of human rights protection,the quality of criminal legal aid has been gradually concerned.However,due to various reasons,there are some problems in the defense quality of criminal legal aid.These problems include the poor quality of the defense rate,the difficulty of the defense counsel for criminal legal aid,and the refusal of the judge to adopt the defense counsel of the criminal legal aid.The main reasons for these problems are that the criminal legal aid lawyers are difficult to exercise the right to defend them,the time for the intervention of the criminal legal aid lawyers is relatively late,the criminal legal aid lawyers are difficult to comply with the duty of loyalty,and the quality of the criminal legal aid cases can not be paid much attention by the state organs.Therefore,it is necessary to strengthen the guarantee of the quality of the defense of criminal legal aid,evaluate the defense opinions put forward by the judges,optimize the practice environment of the criminal legal aid lawyers,pay attention to the validity of the defense of the criminal legal aid,and construct the supervision mechanism of the quality of the criminal legal aid.
