非法证据排除规则是刑事证据制度中的重要内容,英美是非法证据排除规则的典范。本文先在界定了非法证据的内涵的基础上分析了美国的非法证据排除规则和我国的相关情况,最后在借鉴外国规定的同时联系我国实际情况提出了构建我国刑事非法证据排除规则的设想。

Illegal evidence exclusion rules is an important part of criminal evidence system while the Britain and the United States play as the model of this system.This paper firstly defines the content of the illegal evidence and then analyzes the U.S.illegal evidence exclusion rules and China's relevant circumstances.Finally,the author proposes the idea of constructing China’s illegal evidence exclusion of criminal system by adopting foreign countries’rules to the China’s actual situation.
