Analysis of the legislative demand of resolution mechanism of PPP contract dispute

随着PPP模式被广泛推广,PPP项目合同争议和PPP立法滞后的矛盾逐步放大,政府在争议救济手段上的优势突显,这在一定程度上影响了社会投资者的投资信心。本文从现阶段PPP项目合同争议解决机制之间的法律冲突、法律衔接以及社会资本在整个合同体系中的劣势地位几个方面论述了制约PPP发展的多种因素,提出了PPP立法需求的迫切性,以期推动PPP单一立法的进程。

With the PPP mode being widely popularized,the contradiction between the contract dispute of PPP project and PPP legislation lag has been gradually enlarged. The prominent advantage of government in the dispute relief measures,to some extent,affects the investment confidence of social investors. From the aspects of the legal conflict and legal engagement among the resolution mechanism of PPP contract dispute,as well as the inferior position of social capital in the contract system at this stage,this article discusses various factors restricting the development of PPP and claims the urgency of PPP legislation needs in order to promote the PPP single legislative process.
