摘要
本文探索了中国化妆品监管治理体系的系统建构,指出应明确监管目标,强化监管协作,提高监管专业化程度,夯实监管机构,以强化化妆品行政监管能力。通过引入专家治理,倡导行业协会的自我监管,强化企业责任,建构中国化妆品监管的合作治理网络。应明确"化妆品"的概念,健全与完善化妆品监管立法,建构化妆品监管法律体系。改革化妆品监管方式,整合与削减化妆品行政许可,建构由国家标准、企业标准、团体标准组成的新型标准体系,完善强制信息披露制度,建设化妆品生产经营企业安全信用体系,建立举报奖励制度。完善化妆品安全风险监管体系。本文还讨论了中国风险监管面临的普遍困境,提出了引入制度建构型行政法学的可能性。
This article discusses the institutional building of cosmetic regulatory governance network in China.It points out that it should clarify regulatory goals,strengthen agency coordination,and enhance information network and training,to strengthen capacity.To introduce expert governance,self-regulation and corporate responsibility,build collaborative regulation network in cosmetic governance.It should clarify the concept of'cosmetic',to revise related rules and regulations.To reduce and simplify administrative licenses,reform novel technical standard system,to introduce information disclosure regime,establish credit system and whistleblowing regime,and introduce risk regulation philosophy into cosmetic regulation.It also discusses the general dilemma in current risk regulation of China.It points out that,it is necessary to introduce'institutional-building administrative law'into our academic study.
