论我国互联网金融消费者纠纷解决机制的构建 被引量:16

摘要 随着P2P网贷和股权众筹等互联网金融交易在国内的迅猛发展,其本身蕴涵的风险也在实际交易中凸显出来,而受伤害的是广大金融消费者。面对此种现状与问题,亟需从保护金融消费者权益入手,研究构建互联网金融交易中的金融消费者纠纷解决机制。本文通过对国内外金融纠纷解决机制,特别是FOS(金融申诉专员制度)、ODR(在线纠纷解决机制)等制度进行分析,重点研究需要纳入到互联网金融纠纷解决机制的具体制度、如何实现与我国现有金融ADR制度(替代性纠纷解决机制)的衔接以及下一步具体的制度构建等问题,并提出符合我国实际、适度超前的互联网金融交易多元化纠纷解决机制,为金融消费者提供公正、便捷、高效的权利救济渠道。 With Peer-to-Peer Lending and Crowd funding and other Internet financial transactions rapid development,the risks inherent in its own also stand out,hurt the majority of financial consumers.Faced with this current situation and problems,we need start from the protection of the rights and interests of financial consumer to construct the resolution system of the Internet financial consumer disputes.By domestic and foreign financial dispute resolution mechanisms,in particular FOS(Financial Ombudsman system),ODR(online dispute resolution mechanisms)and other systems for analysis,this paper focuses on the following issues,such as the need to incorporate the specific system of Internet financial dispute resolution mechanism,and how to achieve convergence with our existing financial system ADR(alternative dispute resolution mechanisms),the specific construction of the next system and other issues.Finally,build in line with China's reality,moderately ahead of the diversified dispute resolution mechanisms in order to provide financial consumers fair,convenient and efficient right to relief channels.
