摘要
当下,人民调解制度正在复兴。在复兴过程中,人民调解制度基本的理念、价值取向和运行机制并没有得到充分梳理,由此可能深层次地影响人民调解制度的健康发展。本文基于当前人民调解制度的复兴趋势,详细阐述了人民调解制度的主体性和工具性理念,并继而切入人民调解制度的传统性和现代性价值。在详细阐明制度背后的理念和价值取向后,本文指出,人民调解制度的现代复兴,正是理念和价值的具体化。
People's mediation is reviving currently,meanwhile the fundamental ideas,value orientation and functional mechanism of this institution have not been adequately articulated,which may have some deep influence on the healthy development of people's mediation.Based on the revival trend of people's mediation,the article here elaborates the subjective and instrumental ideas of people's mediation institution,and then introduces its traditional and current value.After elaborating the ideas and values behind the system,the article contends that the modern revival of people's mediation is exactly the concretion of the ideas and values.
