对亚当·斯密、哈耶克和布坎南等自由主义经济学家理论的分析和对市场原教旨主义的批判,结合"亚洲四小龙"取得的"东亚奇迹"、发展中国家的发展经验、俄罗斯"休克疗法"改革的失败、中国几十年的经济增长以及目前中国经济改革的实践,充分地表明国家干预是市场体制的核心内容。"市场在资源配置中起决定性作用",不可误解为"市场在资源配置中独自起作用",或者"只有市场在资源配置中起作用"。国家干预不仅是中国特色社会主义市场经济与自由资本主义市场经济的重要区别,也是它较之自由资本主义市场经济的优越之处。作为对市场经济关系记载和表述的经济法自然要将国家干预视为其基本范畴,经济法本质上是一种确认和规范国家干预的法律制度。要改革和完善经济法,关键是要建立健全一套法治化的国家干预法律制度,具体包括国家干预的主体、权限、范围、启动、选择、程序、手段、评价、责任、退出等方面。
