摘要
随着在华外国公司与个人数量的急剧增加,外国公司与个人在华犯罪问题成为不容忽视的社会问题,而与此相适应的立法、司法和理论研究却严重滞后。通过剖析最近十年来外国公司和个人在华犯罪的表现、规律和特征,本文揭示了在中国刑事政策、刑事立法、刑事司法等方面在应对外国公司和个人犯罪过程中的诸多滞后与缺憾之处。并对如何构建与中国大国地位相适应的、与中国对外开放和国际化进程相呼应的,应对外国公司和个人在华犯罪问题的刑事法律体系进行了尝试性探索。
As the number of foreign companies and individuals in China increases sharply,the criminal offenses committed by them have caused severe social problems,which we cannot afford to ignore. However,legislation,judicatory practice,and theoretical research relative to this issue are seriously lagging behind. By analyzing the appearances,patterns,and features of criminal offenses committed by foreign companies and individuals in the recent decade, this thesis reveals the shortcomings of criminal policies,criminal legislation, and criminal judicature of China in handling the foregoing issue. Moreover, this thesis also attempts to explore the establishment of a criminal legal system effective enough in dealing with criminal offenses in China committed by foreign companies and individuals,a system that befits China's great-power status and corresponds to its opening-up policies and internationalization process.
