共有物分割诉讼是形成诉讼,但分割判决兼具形成判决与给付判决的性质。其本质是非讼事件,虽然被称作"形式上的形成之诉",但具有"诉讼化审理"的特征,此为共有物分割诉讼的二元属性。分割共有物诉讼系共有人利用诉讼程序,请求法院判决确定分割方法,共有人所争执的仅为分割方法的事实关系,这也是分割共有物诉讼是非讼事件的本质所在,故诉讼标的应为确定分割方法的请求。

The action of partitioning res communes is action of formation,the partitioning judgment has the nature of formation judgment and payment judgment.The action has the nature of non-contentious matter and is called as formal action of formation,but it also has the characteristics of litigation trial.In the action,the coowners use the procedure to request the court to determine the partitioning methods,the dispute which the coowners disagree is that factual relation of partitioning methods,this is also the essence that the action is noncontentious matter,so the object of the action is the claim of determining partitioning methods.
