自我认证式准入对当前阶段我国汽车产品管理的适用性研究

Research on the Applicability of Self-certification Admittance to Automobile Product Management in China at the Current Stage

从美、韩两国自我认证式汽车准入程序和实施背景入手,分析自我认证式汽车准入优点和不足,从产业发展和法律环境方面总结实施自我认证的条件基础,并基于当前我国汽车产业发展和相关法律法规实际进行适用性分析。结果表明我国目前尚不具备实施自我认证式汽车准入的产业和制度条件,建议近期汽车准入制度调整应当以强化监管能力和推进法制建设为重点。

Starting from the process and background of automobile self-certification in the U.S.and South Korea,this study analyzes the advantages and disadvantages of automobile self-certification system,summarizes the conditions and basis of self-certification from the perspective of industrial development and legal environment.This study also analyzes the applicability of self-certification to China,based on the current automobile industry development and relevant law system.The results show that China does not have the industrial and legal conditions for the implementation of self-certified auto market access at present,and suggest that the recent adjustment of auto market access rules should focus on strengthening the regulatory capacity and promoting the construction of legal system.
