美国对华反倾销实证与比较

An empirical analysis and comparative study of U.S. antidumping to chinese export goods

美国作为四个传统的反倾销国家之一 ,其反倾销法与实践历来备受各国政府、企业、法律界及学术界的关注 ,我国对此也非常重视。作者将美国对华反倾销进行了实证比较研究和剖析 ,指出美国反倾销在国际反倾销和对华反倾销中均具有十分重要的地位 ,同时美国又是国际反倾销指控的重要对象 ;美国对外反倾销重点指控的是钢材及其它金属、化工、食品、机电和纺织等产品 ,中国已成为美国反倾销的主控对象 ;美国对外反倾销措施有不断强化的趋势 ,征税案比例一直在上升 ,且涉案金额逐渐增大。对此 ,我国要高度重视并积极加以防范。

U.S.A. is one of four main traditional users of anti dumping policy in the world. Its antidumping law and practice has aroused increasing concern of governments, enterprises, the law world and academic circles. China also pays much attention to this but no analysis of it has been made. This paper gives an overall analysis of this problem. The author′s conclusion is that the American anti dumping has important status in the world anti dumping regime and at the same time, U.S.A. is the major target of the international anti dumping regime. U.S.A. imposes anti dumping duties mostly on imports of steel and other metals, chemicals, food, mechanical and electrical equipment, textiles, etc. China had become the main target of the American anti dumping regime. The proportion of anti dumping duties has been rising all the time, and the amount of money concerned is crescent. We should pay much attention to this and take precautions against this.
