On the System Logic in Membership Right of Chinese Farmers

中国农民成员权是特定范围农民的群体性权利,以农民集体成员资格为基础,将集体权益归属于农民,农民成员权制度以村社农业资源为依托,以村社集体为利益配置单位,实现土地保障功能。农民成员权制度以安全秩序为主导价值,以村民身份、村社治理规则为技术手段构造法律制度,规范村民、村社、村委会、集体经济组织、政府、外部人之间关系,并依赖集体农地利益保护、村社功能保护、农民身份利益保护以及代位诉讼等多层次的机制实现权利保护。

Membership right of farmers in China is the mass right of farmers in the specific field,based on the legal qualification of farmers group,which returns the collective interests back to farmers. Membership right system of farmers,supported by agriculture resources and with collective interests as the allocation unit,actualizes the function of land guarantee. Therefore,it maintains the tenor of village organizations,and strengthens the function of land security. Membership right system of farmers takes the security order as the leading value,and takes the identity of the villagers and village governance rules as technical elements to set up law systems,and it standardizes the relationship between villages,villagers,government,outsiders,village committees and collective economic organizations. It also resorts to diverse- level systems such as collective farmland interest protection,village organization functional protection,farmers identity interest protection and subrogation litigation to realize the protection of membership' rights of farmers.
