摘要
围绕政府与市场关系这一基本议题而展开讨论。首先,从认识作为公共行政的城市规划和政府体系中城市规划管理的权域和协调域两方面,剖析了市场体制中城市规划的现实状态。其次.论述了城市规划的作用范围是城市物质空间形态中有关公共利益的公共价值域,在市场体制下是应该受到政府控制的部分。然后,论述了开发控制的法理基础和物权特征,指出城市规划实施开发控制是通过对物权量的设定,使各相关主体能够形成对未来开发利益的理性预期,从而作出合宜的决策。最后,该文就应对市场,完善以开发控制为核心的城市规划体系,在规划研究、规划编制和规划管理方面提出了一些对策。
The paper develops around the basic topic-the relationship between the government and market. Firstly, after study the urban planning acting as public administration, and the power-domain and coordination-domain of urban planning administration in government system, the paper analyses the real status of urban planning in market system. Secondly, the paper discusses that the affective range of urban planning is public-value domain about public interest in urban material space form, which should be parts of governmental control under market system. Thirdly, the paper studies the development control from both legal base and property-rights character. It points out that by setting the quantity of property-rights quantity, the reasonable expectation about future development can be formed by relative subjects, and suitable judgment will be made. Therefore, the urban planning carries out development control. Finally, in the respect of planning study, planning organization and planning administration, some suggestion about perfecting the urban planning system centered on development control is put forward.
