劳动合同法的立法评析——以马克思主义理论为视角

摘要 我国《劳动合同法》在创制过程以及实施过程中都引起了巨大的争议。面对这些争议,本文将以马克思主义理论——特别是其中的劳动力商品化理论与实践反思理论——作为分析相关问题的基本理论立场。根据上述理论,我国《劳动合同法》的创立有助于防止资本逻辑的过度扩张,有利于保卫民主与社会公正机制。但是,在劳动者权利保障的立法活动中,我们也应建立一种实践反思机制,从而实事求是地分析我国的相关现状与问题。 The legislation and implementation of Labor Contract law bring fierce debates.In the face of these debates,the paper will take the Marxism theory,especial labor force commercialization and practice reflection theory in Marxism,as the basic theoretical position to analyze the related problems.According to these theories,the legislation of Labor Contract law in our country will help to prevent the excess overspread of capitalism logic and secure the mechanism of democracy and social justness.However,we should establish a mechanism of practice reflection in the legislation for ensuring the right of laborer so as to analyze the actuality and problems in our country practically and realistically.
