论传统中医网络诊疗基本法律制度的建构

On the Construction of Basic Legal Systems of Cyberspace Diagnoses and Treatments of Traditional Chinese Medicine

传统中医以望闻问切四诊为主的诊疗疾病的独特性,决定了其一定程度上开展网络诊疗的可行性和现实性。但传统中医网络诊疗具有其自身的诸多特点和利弊,这既彰显了传统中医的优势,也在一定程度上制约了其适用范围。构建传统中医网络诊疗基本法律制度必须考虑到传统中医网络诊疗的特点和利弊,在卫生管理机关中设立独立的网络诊疗管理机构、建立完善的中医网络诊疗网站准入审查机制、完善规范的中医网上执业医生行医资格审查制度、限制一定种类的病种和病症进行传统中医网络诊疗、制定适合的网上问诊制度、设计好适合网诊的问诊单等等,而更具有决定意义的是加快有利于我国中医药发展的立法进程。

While the uniqueness of diagnostic methods as"Wang,Wen,Wen and Qie"in traditional Chinese medicine suggests to some extent the feasibility and practicality of cyberspace diagnoses and treatments,it also has many specific features and advantages and disadvantages,which demonstrates the advantages of traditional Chinese medicine as well as to some extent constraints the scope of its applicability.The construction of basic legal systems of cyberspace diagnoses and treatment of traditional Chinese medicine should take all the features of traditional Chinese medicine into consideration,requiring such issues as the establishment of independent management office of cyberspace diagnosis and treatment in national administration institutions of public health,the development of registering censorship of websites for cyberspace diagnosis and treatment of traditional Chinese medicine,the advanced regulation of Certificate for Medical Practitioners of Chinese Medicine on Websites,the constraint of certain kinds of diseases which can be diagnosed through cyberspace diagnoses of traditional Chinese medicine,the formulation of proper institutions and medical assessment forms for cyberspace diagnoses.All these measures can be undoubtedly conducive to the legislation progress of Chinese medicine in China.
