'社会管理'是一个发展性概念。经济发展到特定阶段,社会原有管理模式滞后,失范的危机显现,更高层级的社会需求在法律中得到回应。改革与创新社会管理的实质并不是一般意义上构建新规范,而是在市场经济不断发展的前提下建立法治社会,实现公平、正义、民主,促成各种合理政治利益诉求实现。这是尊重民权与改善民生的价值依归,是人类需求的更高层级的追求,是公民自身价值的更深层次的实现。用法治建设推进社会建设与管理是时代的迫切要求,而其中关键在于落实现行宪法。协商民主制度的建立与结社自由共同推动第三部门的兴起,可以说这是当前构建宪法实施机制创新社会管理的有效途径。

“Social management”is a developmental concept.When social economic develops into a certain stage,the original social management mode lags behind,and the crisis of anomie appears,so a higher level of social managements is demanded in law in response.The essence of reform and innovation of the social management is not just the general sense of setting up new standards,but setting up agovernment by law on the basis of a developing market economy,achieves fairness,justice,democracy,realizes all kinds of reasonable political interest demands.This is the value made for respecting civil rights and improves the people's living standards,the pursuits of human needs of a higher level,and the realization of the citizens of them all to a deeper level of values implementation.With the construction of the laws to promoting social development and management is the demands of the era,and the key of which is to implement the current constitution.The establishment of the system of the deliberative democracy system and the freedom of association all together promotes the rising of the Third Sector,this is can be taken as an effective way to build the implementation of the social management innovation of mechanism at present.
