创新社会管理要树立现代宪政理念,适应社会管理法治化要求,重在构建宪政框架内的社会管理法律体系。因此,要建立选举民主与协商民主相结合的宪政治理平台,科学界定行政和社会组织的权责范围,健全社会管理主体的法律体系,进一步完善社会管理法律实施的程序机制,增强社会管理可操作性和实效性,并建立健全社会管理的监督、问责以及纠纷解决机制,完善保障民生、服务社会的法律体系。从而创新社会管理,进而达到善治,实现社会和谐,走向更高、更新、更好的宪政。

Social administration innovation should set up modern concept of constitutionalism and meet the requirement of the legislation of the social administration,with emphasis on building the legal system of social administration within the framework of constitutional government.Therefore,it needs to create a platform for constitutional government which combines the democratic election and democratic consultation,to scientifically define the range of power and responsibility of administration and social organization,to perfect the legal system of social government body,to further improve procedure mechanism of the actualization of social administration law,to strengthen the maneuverability and actual effect of social administration,and to set up and perfect the mechanism of monitoring,accountability and dispute solving,as well as to improve the legal system to safeguard the people’s livelihood and serve the society.Consequently,social administration innovation will achieve and then followed with good governance and social harmony,which will lead to a higher,newer and better constitutional level.
