Global Antitrust Policies:How Wide is the Gap?

2011年9月6日,纽约福特汉姆法学院举行了国际反垄断法高端研讨会,美国司法部反托拉斯局国际事务特别顾问瑞秋·布兰登勃格和联邦贸易委员会国际事务部兰迪·特莱特尔主任为参会的竞争法律师做了主题报告,本文是由二人在该研讨会上的发言整理而成,发表于Concurrences Journal 2012年第1期。本文主要包括国际反垄断法九个方面问题,有助于我们了解美国竞争执法机构高级官员对反垄断政策趋同的观点,以及全球反垄断政策的最新动态,对于研究中国反垄断法的有效实施、保护中国企业利益和促进消费者福利有着重要的借鉴意义。

The paper is based on a panel discussion with the top international officials at the two US antitrust agencies(Rachel Brandenburger and Randy Tritell)in New York for a conference(at Fordham Law School)on international antitrust law.The discussions include the current state and future of convergence between U.S.and Europe on antitrust policy and approaches,multilateral efforts within the OECD and the ICN,U.S.-Europe cooperation,cooperation with China’s three antimonopoly enforcement agencies,Cartel Sanctions and International Cartel Enforcement,deterrent effect,the changes and challenges about international convergence.
