对中华法系“同步性特征”的检讨

Review of the Chinese Legal System’s “Synchronization Characteristic”

中华法系的特征,是研究中华法系无法绕开的问题。有学者从历史发展的视角提出,中华法系在发展进程上存有与封建社会尤其是政治兴衰协调一致的同步性特征。本文从成立'特征'的标准出发,分两个层次,即同步性是否真实存在,以及这种同步性是否构成中西古今对比意义中的特征对该命题进行检讨,并指出法系变迁与封建社会发展并不严格同步,而中华法系这种非严格的同步性也体现在其他法系和社会政治的对应关系中,仅仅在古今对比的弱势意义上可称之为特征。

The study of the characteristics of the Chinese legal system is an inevitable subject of the study of the Chinese legal system.Some scholars have put forward,from the perspective of historical development,that there is synchronization characteristic between the Chinese legal system and the feudal society in the development process.The Chinese legal system is coordinated with the rise and fall of politics.This paper starts from the establishment of the standard of"characteristic"and then reviews this proposition at two levels:whether the synchronization is real,and whether this synchronization is the characteristic of the contrast of ancient and modern,Chinese and foreign.This paper points out that changes in the law are not strictly synchronous with feudal society.This non-strict synchronization in the Chinese legal system is also reflected in the other correspondent relations between law systems and social politics.This non-strict synchronization can be called characteristic only in the weak sense when we contrast the ancient and modern.
