理论与实践相结合的朝阳法律人——管欧法律思想初探

Chaoyang Scholar Combining Theory with Practice:Juristical Thoughts of Lawyer Guan Ou

1929年,在世界法学会海牙会议上,朝阳大学被肯定为'中国最优秀之法律学校'。朝阳大学在创立之初就强调理论与实践相结合的法律研究思路,作为朝阳大学的法律人,他们担负着中国法制近代化建设的重担。他们中有的著书立说,殚精竭虑;有的以司法、立法实践为手段,投身法治,积极奔走,而他们共同秉承了一种理念——法律是一门从实践的角度进行理论研究,再应用于实践中的学科。著名法学家管欧教授就是朝阳法律人的杰出代表。本文即从管欧教授的生平简介、他在当代法学史的地位,以及他在行政法方面的独到见解等方面呈现管欧教授的法律思想,借以填补我国行政法学史上空白的一页。

In 1929,at Hague conference of the International Law Society,Chaoyang University was regarded as'China’s most outstanding law school',Since its establishment,Chaoyang University emphasized the research method of the combination of theory and practice.As Chaoyang University lawyers,they carried the burden of China’s legal modernization construction in that period.Some of them wrote books and some took an active part in judicial and legislative practice.But they held the same idea that law was a practical discipline professor Guan Ou was one of them.This article reflectes his juristical thoughts from the aspects of his biography,his statue in law history,his original ideas of administrative law and so on.
