摘要
由于用人单位无法给实习生办理工伤保险,商业保险存在缺陷,单位自身承担风险较高等因素导致实习生在工作中遭受意外伤害缺少必要的保障。困局的出现源自实习生身份的双重性和对其劳动关系认识的模糊,事实上实习生的学生身份并不影响其作为劳动者的资格,只要和用人单位签署实习协议就可认定符合社会保障中的劳动关系。建议实习生意外伤害问题可采取纳入社会保障体系、完善实习生责任保险、人身意外伤害险作为'福利'等多元化路径解决。
Since the employer can not provide injury insurance for the trainees, while commercial insurance has fl aws that left the employer bear higher risk, the trainees then lack of necessary compensation when accidents happen. Diffi culties arise from the trainees’ dual identity and their vague understanding of labor relations. While, in fact, the identity of student trainees shall not limit their qualifi cations as regular employees. As long as they sign internship agreement with the employers, they can enjoy the insurance. The paper suggests the issue can be solved in the following ways: incorporating the trainees into social security system, improving intern liability insurance, and providing personal accident insurance as "welfare" and so on.
