试论走私犯罪主观方面的若干问题

On Issues of Subjective Aspects of Chinese Smuggling Crime

犯罪主观方面是行为人承担刑事责任的主观基础,是指犯罪人实施犯罪行为时,对其行为引起的危害社会的结果所持有的心理态度——故意、过失以及动机和目的。本文论述了关于"以牟利为目的"是否为构成走私罪必备要件、走私犯罪故意是否包括"间接故意"的理解、不确定走私犯罪故意的认定、走私犯罪主观故意中"应知"的认定等内容。

The subjective aspects of crime,the subjective basis of the criminal responsibilities of criminal,is defined as the criminal' s psychological attitudes,i.e.intention,fault and motivation and purpose, to the bad consequence on the society by criminal' s activities when criminal initials the criminal activities.This paper articulates the issues as follows:(1) whether'aimed at profitability'is a prerequisite for the determination of smuggling crime;(2)whether smuggling crime intention includes'indirect intention';(3) the determination of uncertain smuggling crime intention;(4) the subjective aspects such as the judge of'shall know'in the smuggling crime subjective intention。
