俄罗斯是世界上对刑事执行活动进行规范性立法的国家之一。其基本的刑事执行规范源自于沙俄帝国时期的监狱规范与俄罗斯苏维埃联邦时期的劳动改造法典,现行的俄罗斯刑事执行立法是制定于1996年的《俄罗斯联邦刑事执行法典》,该法典构造了俄罗斯基本的刑事执行法律体系,对刑事执行的概念与职能、关系与体例、目的与任务以及基本刑事执行原则等问题做了较为明确的规定,具有结构完整、体系合理、内容全面等特点,较好地反映了俄罗斯当代刑事执行政策的立法导向,对刑罚执行人道化、个别化、社会化及宽缓化等价值目标贯彻得较为彻底,既有利于被处刑人员矫正,也有利于其释放后向社会的回归。据此,该研究对于我国创建刑事执行立法体系、推行与贯彻刑事执行政策具有一定意义。
