摘要
刑事司法政策的形成、执行属于动态意义上的刑事司法政策问题。根据决策科学的要求,一方面,刑事司法政策的正当形成最起码应当包括政策建议的提出和政治决策的做出两个环节。另一方面,其过程应当包括"决策—执行—评估—再决策—再执行"五个阶段,其模式也应当具有突出的多元、模糊特征。
The formation and implementation of criminal justice policy belong to the dynamic sense in criminal justice policy issues. According to the requirements of scientific decision-making,on one hand, the formation of criminal justice policy in the very act should at least involve two aspects:bring forward the policy suggestion and make the political decision.On the other hand,it is a process which starts from decision-making-enforcement-evaluation—decision-making again-enforcement again in the end.And its pattern is ought to be prominently polynary and indistinct.
