本文采用比较的方法 ,就合同撤销权与无效确认请求权的竞合问题进行了初步探讨。作者认为 ,对无效合同如具备可撤销之原因 ,同样可以行使合同撤销权 ;合同撤销权与无效确认请求权可并行存在 ,并不相互排斥 ;

This paper discusses the concurrence of the contract repeal right and the invalidity affirming right. It is pointed out that if an invalid contract can be repealed, it is feasible to perform the contract repeal right; the contract repeal right and the invalidity affirming right may coexist and do not repel each other; it is appropriate to deal with the concurrence problem of the contract repeal right and the invalidity affirming right from the legitimate rights and interests of the litigant.
