论国际标准下我国刑事诉讼人权保障功能的完善

On the Improvement of the Human Rights Protection in Chinese Criminal Procedure against the Global Context

刑事诉讼的人权保障功能 ,是随着社会发展而发展的 ,这一方面表现在人权从国内立法保障到国际标准的形成和各国的普遍接受 ,另一方面也表现在人权保障的内容不断发展。在我国 ,刑事诉讼人权保障的内容有了很大发展 ,也正和国际标准趋向一致 ,但是 ,还存在着值得完善的地方。

The protection of human rights in crimial procedure develops in line with the development of human society.As we can see,traditionally,the protcetion of human rights is ensured by law of a single country,whereas international law and convention is enacted to further the protection of human rights nowadays.At the same time,there is an ever increasing trend what should be protected according to international standard.Basically,the Criminal Procedure Law of the People's Republic of China conforms to the world trend regarding human rights protection.However,it still needs improving.
