摘要
儒家法伦理思想作为中国传统政治法律文化资源的重要组成部分 ,对现代中国法治和德治有深刻的影响 ,尤其是对于现代法律文化的建设 ,影响更是不容忽视的。儒家法伦理思想无论是作为建设新的法律文化的参考资料 ,还是其背负的沉重包袱 ,都需要认真地梳理、评价、激浊扬清。
As an important part of Chinese traditional culture of politics and law, the legal ethic theory of the Confucianism has had great impact on both rule of law and rule of virtue in modern China, especially on the construction of China's modern legal culture. The impact must not be ignored in the least degree. Thus the legal ethic theory of the Confucianism should be cleared up, valued and sublated before we decide whether it is consultable or functions as an obstacle in the building of our new legal culture.
