摘要
著作权权利管理信息保护制度是版权条约和许多国家针对网络环境专门设计的平衡著作权和使用人利益的新规则 ,对比传统的权利信息制度 ,其功能、内容均发生了重要的变化。我国相关制度尚属空白 ,迫切需要立法加以确立。立法设计应考虑权利管理信息形态选择 ;权利管理信息的规范内容 ;权利管理信息规则应注意与著作权电子商务的对接。
In the treaties and in many countries,the system of protection of rights management information of copyright is a new rule that is specifically designed for the network environment to balance the interests of copyright owners and users. Being compared with the traditional rights information system,its functions and contents both have great changes.The relevant system in China is still vacant and needs to be created imminently through legislation.The following factors should be considered in the legislation design such as modality selection of right management information,the regulatory contents of right management information, and the joint of right management information regulations and electronic business affairs of copyright.
