刑罚轻重的根据——兼论“严打”

Grounds for Light and Heavy Punishments——and on "Strike-hard" Campaign

对于贝卡利亚刑罚宽和观应当进行历史的分析 ,对于中国当前“严打”合理性与否的认识离不开中国当前特定的历史环境。一方面 ,刑罚的使用应当谨慎 ;另一方面 ,当前我国刑罚的使用应当重于西方国家 ,并赞成有节制的“严打”。

Historical analysis should be done to Beccaria's view of lenience.Understanding whether the current'strike-hard'campaign in China is reasonable or cannot be separated from the special historical circumstances of China.On one hand, punishment should be used with caution;on the other hand,at present the punishment in China should be heavier than that of western countries and the moderate 'strike-hard'campaign is approved.
