摘要
中国法官、检察官、律师资格取得的统一考试制度的启动 ,是新中国法制文明发展进步的一大飞跃。但建立中国特色社会主义的司法考试制度 ,应当在考试管理体制、考试方式、品行考核等方面科学设计 ,合理规范。司法考试不应当是过去律师考试的翻版。司法考试应当克服一次考试定终身、重法条而轻法理等弊端。
Starting the uniform examination system for people to get the qualification of judges, prosecutors or lawyers in China is a great leap in the progress and development of legality civilization of New China.However,the establishment of judicial examination system with Chinese socialist characteristics should be scientifically designed and reasonably regulated in the aspect of examination management system,methods of examination, and moral check.The judicial examination should not be the reprint of the former bar examination.It should overcome the following drawbacks: an examination can decide one's fate;prescriptions of law are more emphasized that jurisprudence.
