摘要
近来,某法院对承办案件的一名警察判处了伪证罪。但在现行法律中并不能直接找到警察能够作为伪证罪主体的合理依据。不过,单就诉讼证据理论而言,承办案件的警察具备证人资格,因而可以构成伪证罪主体。
Recently,a court gave sentence upon a policeman for per- jury.However,the verdict was short of legal bases.But then,the police- men possess the competency of witness in the theories of evidence.So po- liceman can compose the subject of crirne.
