“经济人”不仅对物质利益的“激励”有“反应”,而且对“精神利益”的“激励”有“反应”。换句话说,法律既可以用物质利益对人的行为进行“诱导”,也可以用“精神利益”诱导。“精神利益”应该是法的经济分析方法之核心概念“利益”的重要构成部分,它在法的利益诱导模式中与物质利益起着同样重要的作用。
