摘要
撤销权制度是我国新合同法中确立的一种新的债权保障制度。就我国新合同法中撤销权的概念与性质、成立要件、行使及行使的效力进行比较系统的探讨 ,同时指出其存在的不足 。
The rescind system is a new system to guarantee the creditor′s right established in the new contract law of China. This paper expounds the concept, element, enforcement, and effectiveness of the rescind system, it also points out the defect and provides some supplementation and perfection.
