摘要
事实发现是法律适用的基础,事实认定实行证据裁判主义,因而证据法在法律体系中的地位是非常重要的。证据法的经济分析,简而言之,就是从效率的维度对证据法进行诠释。波斯纳法官从事实发现的成本-收益分析、机会成本分析、激励分析、效率分析等视角入手,全方位地揭示了事实发现的效率维度。其核心思想是以效率诠释正义,以法律引导效率,将古典经济学为基础的价格理论等简明的经济原理运用于法学理论以及具体法律部门、法律制度的研究。
Fact-finding is the basis for legal applications. In the final analysis, it is evidence that rules. Hence, the law of evidence is critical in the entire legal system. Judge Posner applies the price theory of classic economics to the studies of law and reveals the efficiency of fact-finding through such perspectives as cost-benefit analysis, opportunity cost analysis, incentive analysis, efficiency analysis, etc. His core idea is to interpret justice by efficiency and to direct efficiency by law.
