摘要
代表不同法系的主要发达国家在处理学生伤害事故时表现出一些共同点:归责时呈现出归责原则的类同性、责任范围的有限性及过失责任的情景性;确定赔偿主体时体现出公立学校学生伤害事故为学校设立者、私立学校学生伤害事故为教师个人的"二元"性。
when developed countries represen different legal systems to deal with students′ injury accidents,they show some general characters:similarity of liability rule,limition of liability range,context of negligence;'two poles'are the character of affirming subject of compensation,that is,the constructors of public schools are subject of compensation or the teachers in private schools are subject of compensation.
