网络知识产权是网络经济活动中的一项重要权利且具有与传统知识产权相区别的鲜明特征;但是网络知识产权一旦被滥用就会破坏网络经济活动的正常竞争秩序、损害其他竞争者和消费者的合法权益。网络知识产权滥用可以概括为滥用市场支配地位和垄断联合两种基本形式。从网络知识产权的视角考察,"3Q之战"也是网络知识产权滥用的一个典型案例;通过"3Q之战"案例,分析和反思网络知识产权滥用的法律规制具有十分重要的理论和实践意义。

Intellectual Property of network is one of the important rights in network economic activity and it can be differed from traditional intellectual property with its distinctive features.However,it is easy to destroy the normal competitive order and the legitimate interests of competitors and consumers of the network economic activity once abused.There are two basic forms of misusing the Intellectual Property of network, including the abuse of market dominance and the union monopoly.To investigate the perspective from intellectual property of network,we can argue that the war between 360 and QQ is a typical case of the abuse of the network intellectual property.It is important to analysis and reflect the legal regulation of the abuse of Intellectual Property of network for its theory and practice meaning by the case of "The 3Q war".
