摘要
本文立足于法和经济学的分析方法 ,揭示了我国农村土地承包经营权制度效率低下的根本缘由 ,提出了增进这一制度效率的立法途径。认为 :从经济分析角度看 ,重构农村土地集体所有权制度乃是立法成本最低的一种立法路径 ,从交易成本理论考察 ,应将村民小组界定为集体土地所有权主体 ;土地承包权的物权化有助于消除承包合同双方的协议障碍 ,降低交易成本 ;物权法在对土地使用权进行权利配置时 。
The author asserts that it represents the most cost effective legal approach to restructure the collective ownership system of rural land by means of economic analysis.From the perspective of transaction cost,the farmer groups should be regarded as the subjects of the collective land ownership right.And the materialization of the contractual right of land can facilitate the elimination of the contractual hindrance among the contractual parties and reduce the transaction cost.The property codes should follow different value propositions for different land functions in the allocation of the land use right.
