论司法独立的相对性

<title>On the Relativity of Judicial Independence

鉴于理论界对于司法独立问题的研究倾向于不做分析地引用国外的制度和实践经验而使有关问题的研究陷入了误区,本文强调用分析的方法从民主模式、司法功能和法院级别三个方面对西方主要发达国家的司法独立状况进行了研究,着重突出各国在司法制度的不同领域呈现出不同的独立程度和样态,并依此对中国司法独立制度建设提出了一些新的看法和主张。

<Abstrcat> As an attempt to eliminate the erroneous idea in the study of judicial independence induced by the tendency of appealing to iverseas institutions or practice without any analysis, this article analyzes the influence on the situation of judicial independence in western developed countries exerted by their modes of democracy, judicial function exerted by their modes of democracy, judicial function and judiciary level, so as to put forward some perspective on the establishment of the system of judicial independence.
