摘要
分析了劳动争议与人事争议的主体冲突产生的客观基础和法律上的原因,提出以属人原则处理交叉部分的主体关系,以避免主体冲突。
This paper analyzes the objective conditions and the legal causes of the subject conflict between labor disputes and personnel disputes. It is proposed that to avoid the conflict the subject relationship in case of overlapping should be dealt with in terms of personal principle.
