电子数据、电子文件相关概念的比较与对接

Conceptual Comparison and Linkage between Electronic Data in Law Field and Electronic Records in Archival Field

本文通过分析以《电子签名法》、《关于办理刑事案件收集提取和审查判断电子数据若干问题的规定》、《最高人民法院关于适用〈中华人民共和国民事诉讼法〉的解释》、《最高人民法院关于适用〈中华人民共和国刑事诉讼法〉的解释》等为代表的法学界对电子数据相关概念的界定,以及以《电子文件管理暂行办法》、GB/T 26162.1-2010、DA/T 2000-1、DA/T58-2014等为代表的档案界对电子文件相关概念的表述,对电子数据和电子文件,电子数据的完整性与电子文件的完整性、电子数据的真实性和电子文件的真实性等概念进行比较研究,尝试在两个领域的核心概念之间进行对接。

By analyzing the typical laws and regulations in terms of electronic evidence including 'Electronic Signature Act','Provisions on several issues concerning the collection, extraction, examination, judgment of electronic data of criminal cases','Interpretation of the Supreme People's Court on the Application of Civil Procedure Law of the People's Republic of China','Interpretation of the Supreme People's Court on the Application of Criminal Procedural Law of the People's Republic of China'etc., as well as the key regulations and standards in terms of electronic records management including 'Electronic Records Management Interim Measures', GB/T 26162.1-2010(IDT ISO 15489:1-2001), DA/T 2000-1, DA/T58-2014, etc., the authors compare the concepts of electronic data, integrity and authenticity in law field and the concepts of electronic records, integrity and authenticity in archival field, trying to make a linkage of core concepts between these two disciplines.
