浅析案例教学法在法学教学中的应用

摘要 一直以来,我国法学教学存在理论和实践脱节问题,就是过于看重课堂学习,忽视了学生实践能力的提高,教学和实践两张皮。一些地方高校内容建设方面重视不够,内容比较陈旧,讲的还是过去的技术,与专业教育结合不紧,与实践脱节。学生就业时,发现学习内容适应不了当前社会发展的需要。所以在法学教学过程中加入案例教学法很有必要,一方面可以把一些抽象的法律条文讲得更加形象,另一方面当学生接触到具体的案例时,可以更进一步理解课本上学到的知识,并将其应用于实践中,思维得到进一步扩展。使学生以后到工作岗位中能够很快地进入角色,解决实际问题。本文从案例教学法的内涵入手,分析其在法学教学中存在的问题,并提出实施和改进的措施,对法学教学中如何合理地应用案例教学法有很好的借鉴意义。 For along time,there hasbeen aproblem ofdisconnection between theory and practice in law teaching in China,that is,too much emphasis on classroom learning,ignoring the improvement of students’ practical ability,teaching and practice. Some local colleges and universities do not attach enough importance to the content construction,which is rather outdated. They still talk about the past technology,which is not closely related to professional education and is out of touch with practice. When students are employed,they find that learning content can not meet the needs of current social development. Therefore,it is necessary to add case teaching method in the process of law teaching. On the one hand,it can make some abstract legal provisions more vivid. On the other hand,when students come into contact with specific cases,they can further understand the knowledge learned in textbooks and apply it to practice,and their thinking is further expanded. So that students can enter the role quickly and solve practical problems. Starting from the connotation of case teaching method,this paper analyses its problems in law teaching,and puts forward some measures for implementation and improvement,which has a good reference significance for how to rationally apply case teaching method in law teaching.
