对《中华人民共和国非物质文化遗产法》学习的理解和体会

Understanding Law of the Peoples Republic of China on Protection of Intangible Cultural Heritage

2011年2月25日,全国人大常委会第十九次会议上,表决通过《中华人民共和国非物质文化遗产法》(本文简称《遗产法》),至6月1日正式实施。《非遗法》的颁布是中国文化遗产保护领域、特别是非物质文化遗产保护学界的一件大事,被认为是中国非物质文化遗产保护工作的里程碑,必将对我国的非遗保护实践和研究工作有重大指导和推动作用。中国的非遗保护工作将进入有法可依的新阶段。本文把通过学习《非遗法》,主要是对其内容和特点的个人体会,与诸同好研商。

The Law of the Peoples Republic of China on Protection of Intangible Cultural Heritage,the second national regulation on cultural heritage protection after the Law of the Peoples Republic of China on Protection of Cultural Relics,means significantly for the heritage in danger.The Law reverses the passive situation in the preservation without laws and makes the legal framework more perfect.This paper focuses on the necessity and urgency of passing such a law from the point of view of practice of protecting the intangible cultural heritage in China and the international trend on ICH protection.The paper anglicizes the features of the Law as the following:?the principle of preservation and protection from the perspective of legislation;?the emphasis on the roles of the Government at all levels;?the regulation on the participations of the whole society.All are critical problems in our ICH protection,which is of great significance in directing the protection and research on ICH.
