新《立法法》实施背景下地方立法存在的问题及建议

Problems and Suggestions of Local Legislation with the Enforcement of New Legislation Law in China

我国地方立法实践中不同程度地存在立法权能受限、越权立法、重复立法、地方部门利益法制化的问题。新《立法法》的实施,在为地方立法克服上述问题带来可能的同时,也使其面临新的挑战。在对新《立法法》的亮点与不足进行评判的基础上,得出地方立法出现问题的根源在于没有理顺中央与地方立法权之间、地方立法权主体与社会公众之间、不同地方立法权之间的关系。为了真正解决上述问题,需要以维护法制统一、构建公众立法参与体系、完善地方立法协作机制为重点,保障新时期地方立法工作的顺利进行。

In China's local legislation practices there are problems of limited legislative power,overstepping legislation,repeated legislation and department's interests legalizing.The enforcement of new Legislation Law brings both opportunities and challenges to China's local legislation practice.Based on the highlights and shortcomings of new Legislation Law,it can be concluded that problems of local legislative power lies in the inappropriate relationship between central and local Legislative powers,local legislative bodies and social public,different local legislative subjects.In order to overcome these difficulties,maintaining legislative unification,the mechanisms of public participation and local legislative cooperation should be constructed.
