民法典的编纂为商法通则的制定提供了历史性的机遇。商事立法应当为民法典的编纂做出特殊贡献,其并非民法典编纂之外的立法任务,是对民法典立法及法律实施的跟进。商法通则的制定不仅是社会主义市场经济法律体系完善的内在需求,同时也是营商环境法治化建设的关键环节,而且为"大众创业、万众创新"提供商事法律保障,更有利于为"一带一路"倡议提供制度资源。

The codification of "Civil Code" provides historical opportunities for the formulation of the"General Rules of Commercial Law".Commercial legislation makes a special contribution to the codification of the "Civil Code".It is not a legislative task other than the codification of the "Civil Code",which is a follow-up to the legislation and implementation of the "Civil Code".The enactment of the "General Rules of Commercial Law" is not only the inherent demand of perfecting the legal system of market economy,but also it is the key link in the legislation of the business environment.It also provides commercial legal guarantees for "public entrepreneurship and innovation" and is more conducive to providing institutional resources for the "One Belt One Road".
