A Commentary on the Three Proposals of Antidumping Law

反倾销法一直是国际经济法的一个热点问题,近年来关于反倾销法的探讨已深入到整套制度的合理与否及其发展趋势。本文从经济理论出发,论证了绝大多数倾销行为并非有害行为,而是可接受的商业策略和竞争手段,因此反倾销法从制度上来说具有反竞争的缺陷。本文接着介绍了"完全取消反倾销法"、"以竞争法取代反倾销法"和"对反倾销加以改进"三种方案的观点,分析了它们的可行性,并得出结论,最现实的途径是"对反倾销法加以改进"方案。最后,本文还就我国如何应对反倾销法的发展进行了探讨。

Antidumping law has been a hot topic all along in the field of interna- tional economic law.During these years the discussion about antidumping law has been explored into the reasonableness of the whole system and the trend of its development. Setting out from economic theories,the article proves that most dumping behaviors aren't harmful behaviors,but acceptable business strategies and competition manners, so sntidumping law has the shortcoming of anti-competitive effect in its system.Then the article introduces the viewpoints and analyses the feasibility of the three proposals of 'eliminating antidumping law completely','replacing antidumping law with competi- tion law'and'revising antidumping law',and concludes that the most practical way is the proposal of'revising antidumping law'.In the end,the article discusses the atti- tude with which China should have to face the development of antidumping law.
