摘要
中国虽然已经建立了合理的规制劳动关系的法律体系,但是问题在于如何实施这些劳动标准。本文应用西方的有关理论和中国的有关实践分析了劳动标准在中国实施存在的问题,讨论了如何改善弱势工人群体的雇佣条件以及各种改善实施的方法,其中一些方法涉及到政府机构使用较为复杂的实施技术。但是,更重要的是非政府部门(包括国内和国际企业)和社会组织应当起到重要作用,因此建议所有政府和非政府的实施方法都应予以充分评估并使之充分协调。
This article considers how to improve employment conditions for vulner- able workers.It begins by noting that China has developed quite a sound legislative framework for regulating work.However,the problem lies with enforcement.The arti- cle draws on Western literature on regulation and comparative law and on Chinese em- pirical research to analyze why enforcement is a problem in the Chinese context.Various practical ways of improving enforcement are considered.Some of these involve govern- ment agencies using sophisticated enforcement techniques.However,it is also important for private actors(domestic and international businesses)and social organizations(such as trade unions)to play a key role.The article suggests ways in which the enforcement measures of all these different actors can be evaluated and co-ordinated.
