规则导向模式是 WTO 争端解决机制法律化的理论基础。实践中,WTO 争端解决机制的法律化,在争端解决结构上的不平衡,产生了反法律化的效果。以谈判理论、谈判义务和博弈模型为基础的谈判法理,提供了分析 WTO 争端解决过程和结果的新方法。据此,在中国参与WTO争端解决的谈判方面,需要根据争端问题构建系统、规则和动态的谈判战略。在中国参与 WTO 争端解决规则的谈判方面,应提出构建诉讼和谈判相平衡的争端解决结构的建议。

The paradigm of rule orientation is the basis of the legalization of WTO dispute settlement system.However,in practice,the legalization of WTO dispute settle- ment system has such inherent defaults as unbalance on the dispute settlement structure and the anti-legalization effect.Therefore,negotiation theory,negotiate obligation and game model underlay the negotiation jurisprudence of WTO dispute settlement.From Chi- na's participating the negotiation of China-related WTO dispute perspective,China should establish its own systematic,ruled and dynamic negotiation strategy according to dispute issues.From China's participating the negotiation of WTO dispute settlement rules perspective,China should put forward a new dispute settlement structure in which can keep the balance between litigation and negotiation.
