New Solving Methods of an Old Problem:Analyses on China's Problem of NME in the WTO

世界贸易组织(WTO)《反倾销协议》第27条关于非市场经济国家的规定是以各国的政策选择为基础和主导的。随着WTO的不断扩大和非市场经济国家经济体制改革的进展,这种规定已经不能适应多边贸易体制向着公平和协调目标发展的要求,同时也造成了中国加入WTO以后面临的所谓非市场经济地位问题。本文在分析WTO反倾销制度中非市场经济规则及其缺陷的基础上,进一步讨论了非市场经济地位问题对中国的影响,并提出了通过外交方式和多边贸易体制来解决中国的非市场经济地位问题的政策建议。

Article 2. 7of the WTO Anti-dumping Agreement, which lays the ground of the non-market economy (NME) rules in the WTO members' antidumping laws, is based on the consideration that WTO members choose their own NME policies. However, the recent development of the world trading system and the deepening of economic reform in the NME countries challenge the rationale of WTO NME rules, which also lead to the so called China's NME status problem in the WTO.By analyzing the flaws and negative impacts of the NME rules in the WTO anti-clumping system, the author further discusses the influence of NME status problem to China, and recommends that Chinese government should adopt a policy to solve the NME problem by both diplomatic methods and multilateral measures.
