Report on the Judicial Review of International Arbitration in Chinese Courts

人民法院涉外仲裁司法审查工作主要包括对中国内地仲裁机构进行的涉外仲裁活动依法进行司法监督以及根据1958年《承认及执行外国仲裁裁决的公约》对外国仲裁裁决审查承认与执行。鉴于商事仲裁在解决国际民商事纠纷中日益重要的作用,人民法院全面掌握涉外仲裁司法审查情况具有积极的现实意义。最高人民法院民四庭对2002—2006年间此类案件的办理情况进行了调研,掌握了相关数据,总结了审判经验,归纳了实践问题。

Judicial Review of international arbitration in Chinese courts refer to, inter alia,judicial review of arbitration organized by arbitral instituions in China,and review of foreign arbitral awards in accordance with the 1958 Convention on the Convention on the Recognition and Enforcement of Foreign Arbitral Awards.In view of the importance of commercial arbitration in international civil and commercial dispute settlement,empirical studies of judicial review of international arbitration in Chinese courts are of practical significance.The Supreme People's Court conducted an empirical study of Chinese cases concerning judicial review in international arbitration in the period from 2002 to 2006,which casts light on a number of problems.
